Welcome to Atlantor. These Terms and Conditions ("Terms") govern your use of our website, platform and services available at bookatlantor.com. By accessing or using our platform you agree to be bound by these Terms.

PART A — General Provisions (all users)

1. Scope of service

Atlantor ("Atlantor", "we", "us", "our") operates a digital marketplace that connects travellers ("Travellers") with independent local operators ("Operators") providing nautical tours, water sports and maritime experiences along the Atlantic coast of Northern Portugal and Galicia. Atlantor acts strictly as an intermediary platform. We do not own, operate, manage or provide any of the experiences listed. The legal contract for the execution of the experience is formed directly between the Traveller and the Operator.

2. Modification of Terms

We may modify these Terms at any time. Changes become effective immediately upon being posted on this page, with the "Last updated" date revised accordingly. Continued use of the platform after changes are posted constitutes acceptance of the new Terms.

PART B — Traveller Terms (B2C)

3. Bookings and financial terms

Booking formation: when a Traveller requests a booking through the platform, they are making an offer to purchase an experience from the Operator. The booking is officially confirmed only when Atlantor issues a confirmation email on behalf of the Operator. Pricing: all displayed prices are determined by the Operators and include our platform fee and all applicable value-added taxes (VAT/IVA). Payment processing: payments are securely processed via a certified PCI-DSS compliant third-party payment gateway. Travellers agree to provide accurate and complete payment information.

4. Traveller cancellations, no-shows and refunds

Operator-defined cancellation policies: every activity is governed by its own specific cancellation rules. The independent Operator retains full discretion to set the cancellation window and terms. The unique policy is shown in the description section of each activity page. Weather cancellations: due to the unpredictable nature of maritime and river environments, the Operator may cancel an activity at any time prior to departure if they determine that sea, river or weather conditions compromise passenger safety. When an Operator cancels for safety or weather reasons, the Traveller receives a 100% refund. Operator schedule conflicts and rebooking: if an Operator cannot fulfil a booking for any reason other than weather (e.g. technical or scheduling issues), Atlantor will make reasonable commercial efforts to rebook the Traveller into a similar experience on the same dates. Availability is not guaranteed; if no suitable alternative is found, a 100% refund is issued. Traveller complaint window: Atlantor securely holds the booking funds until the experience is successfully completed. Travellers have a strict 24-hour window after the scheduled completion time of the activity to lodge any formal complaint or dispute the service with Atlantor at hello@bookatlantor.com.

5. Traveller conduct, safety and insurance

Health and skill requirements: the Traveller is solely responsible for ensuring that they and all participants meet any age, weight, health, medical or physical-fitness requirements specified in the listing (e.g. swimming proficiency). Safety compliance: Travellers must follow all safety rules, training instructions and regulations provided by the Operator and their crew (including wearing provided protective equipment like life jackets). The Operator may refuse service to any Traveller who acts recklessly or appears under the influence of alcohol or substances, without any obligation to refund. Personal property: Atlantor and the Operator are not liable for any loss, theft or damage to personal belongings (such as phones, cameras or clothing) brought onto an experience.

PART C — Operator Terms (B2B)

6. Listings, onboarding and platform fees

Free core listing: Operators may create an account and list their maritime activities on Atlantor for free. Commission structure: the Operator enters a net or base price in their login area. Atlantor then calculates and overlays its commercial commission on top of that price to determine the final retail price shown to the Traveller.

7. Atlantor Pro premium service and intellectual property

Service definition: Atlantor offers an optional premium package ("Atlantor Pro") including digital account setup, copywriting of sales-driven descriptions, SEO blog writing, and professional photography and videography, billed via a one-time fixed setup fee. IP ownership and licensing restrictions: all content, photographs, videos and texts produced by Atlantor under Atlantor Pro remain the exclusive intellectual property and copyright of Atlantor. This media is licensed to the Operator exclusively for display on bookatlantor.com and Atlantor's social media. The Operator is strictly prohibited from copying, downloading, scraping or publishing this media on their own website, social media or other third-party booking channels. Media buyout clause: if the Operator wishes to acquire full unrestricted ownership and usage rights of the Atlantor Pro photos, videos and text assets for external marketing, they must pay a flat non-refundable buyout fee of €150.00.

8. Operator obligations, licensing and payouts

Regulatory compliance: the Operator guarantees they hold all active licences, maritime certifications, tourism registry numbers (e.g. RNAAT in Portugal or equivalent Galician tourism registries) and up-to-date civil and maritime liability insurance required by local law to run commercial operations. Accuracy of information: the Operator must keep calendar availability, pricing, safety constraints and descriptions accurate and updated in real time. Operator cancellations and weather: if an Operator cancels due to technical issues or hazardous sea/weather conditions, the Traveller is entitled to a 100% refund. The Operator earns no commission for cancelled bookings and agrees to coordinate with Atlantor to process refunds promptly. Payout terms: earnings from completed bookings (minus Atlantor's commission) are transferred to the Operator's designated bank account on a regular schedule (monthly or bi-weekly), subject to verification that the experience was successfully completed without active customer disputes.

PART D — Legal Liability and Disputes

9. Limitation of liability

Atlantor's liability is strictly limited to its role as an intermediary digital platform provider. To the maximum extent permitted by applicable European, Portuguese and Spanish consumer laws, Atlantor shall not be held liable for any personal injury, death, property damage, delays or other losses arising directly out of or in connection with the execution, failure or cancellation of an experience by an Operator. Unless explicitly stated, individual bookings on Atlantor do not constitute a "Package Travel" arrangement under EU Directive 2015/2302.

10. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the laws of Portugal, without regard to conflict-of-law principles. EU residents may submit complaints through the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. In Portugal, complaints can additionally be filed via the official Mandatory Electronic Complaints Book (Livro de Reclamações Eletrónico) at livrodereclamacoes.pt. In Spain, consumers are entitled to request official consumer complaint forms (Hojas de Reclamaciones) from the Operator at the venue. B2B disputes between Atlantor and an Operator that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Viana do Castelo, Portugal.
